PROMOTIONAL PERIOD

  • Start date: 4 December 2024.
  • End date: 7 January 2025 at 11:59PM, while scratch cards last.

CLAIM PERIOD

  • All prize claims must be submitted by no later than 21 January 2025.

ELIGIBLE ENTRANTS

  • Entry is only open to Australian residents who are 18 years and over.

HOW TO ENTER

  • To be eligible to enter the Promotion, the entrant must purchase any two (2) 750ml Dare or 500ml Dare Iced Coffee products (Promotional Product) from any participating EG Ampol (“Participating Retailer”) in Australia that stocks Promotional Products during the Promotional Period (Qualifying Transaction) and receive a scratch card (“Scratch Card”) at the point of purchase, subject to stocks remaining in the Participating Retailer. It is the responsibility of the entrants to ensure they receive a Scratch Card at point of purchase if one is not automatically provided to them.
  • Entrants must then scratch their Scratch Card to reveal whether or not they have won an instant win prize. Winner/s will be notified instantly in writing on the Scratch Card if they have won an instant win prize or not.
  • There is a 1 in 4 chance of winning a prize.

HOW TO CLAIM AN INSTANT PRIZE

  • In order to claim a Prize, a holder of a winning Scratch Card must, during the Promotional Period, hand over the winning Scratch Card to a Participating Retailer to receive one (1) instant win prize, being a Dare 500mL product (“Prize”) in a flavour of their choice (subject to availability).
  • Winning Scratch Cards are identifiable by having the winning message “CONGRATULATIONS YOU’RE A WINNER” printed under the scratch panel on Card. If the winning statement is not printed under the scratch panel it is not a winning Scratch Card. For removal of doubt, for non-winning Dare Iced Coffee Scratch Cards, the non-winning statement “BETTER LUCK NEXT TIME” is printed under the panel and there will not be a barcode.
  • Only bona fide winning Scratch Cards will be honoured. These may include unique security measures to guard against fraud. The Promoter and Participating Retailer may conduct security verification checks in their absolute discretion. A winning Scratch Card is void if the winning statement does not appear in its entirety, or the winning Scratch Card is stolen, forged, mutilated, or tampered with in any way or if it, or any part of it, fails any of the security and verification checks. Unless otherwise due to fraud or ineligibility under these conditions, all Prize claims in excess of the number advertised as available (but otherwise in accordance with these conditions) will be honoured. The Promoter’s decisions are final and no correspondence will be entered into.
  • Instant win prize claims must be received by a Participating Retailer by close of business on 21 January 2025.

INSTANT PRIZES

  • Eligible Entrants have a chance to win one (1) of up to fifty thousand (50,000) instant win prizes.
  • Each instant win prize is one (1) 500ml Dare Ice Coffee in a flavour of choice (subject to availability), valued at $5 RRP (incl. GST per unit).

  • (a) only one (1) entry is permitted per transaction (regardless of the number of Promotional Products purchased in that Qualifying Transaction in excess of one (1)). 1. The entrant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.
  2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period") and is subject to winning Scratch Cards remining in stock. The Promotion may end earlier if all Scratch Cards are claimed. Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
  3. Valid and eligible entries will be accepted during the Promotional Period.
  4. Employees (and their immediate family members) of the participating retailers, agencies/companies directly associated with the conduct of this Promotion, the Promoter, businesses involved in determination of winner/s for the Promotion, businesses involved in the management of the Promotion, any organisation benefiting from the Promotion, the Promoter’s distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize by the time specified by the Promoter, or is unavailable, they forfeit the prize and the Promoter is not obliged to substitute the prize.
  6. Entrants must keep their winning Scratch Card, as specified above as proof of being an instant prize winner. If an entrant fails to produce the Scratch Card as and when requested by the Promoter, the Promoter has the right to invalidate the entrant's respective entry/entries for which a Scratch Card cannot be provided and/or all entries submitted by that entrant and/or forfeit the entrant's right to a prize.
  7. No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.
  8. No entry fee is charged by the Promoter to enter the Promotion.
  9. Each prize will be awarded to the person who redeems the winning Scratch Card at a Participating Retailer and claims the instant win prize. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
  10. The Promoter's decision is final and no correspondence will be entered into.
  11. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  12. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any Instant Prizes that are won but remain unclaimed will be forfeited.
  13. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.
  14. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth) (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  15. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
  16. The Promoter reserves the right, at any time, to validate and check the authenticity of entries. In the event that a winner cannot provide suitable proof, including the winning Scratch Card, as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win.
  17. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final.
  18. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) arising in any way in connection with: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) this Promotion; or (g) accepting or using any prize (or recommendation). For any liability which cannot be excluded by law, that liability is limited to the minimum allowable by law.
  19. The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material for an unlimited period without further reference or compensation to them.
  20. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
  21. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
  22. We collect personal information in order to conduct the Promotion and may disclose such information to third parties (including agents, contractors, service providers and prize suppliers) for that purpose.  We may also use your information for marketing and promotional purposes.  See our privacy policy at https://begagroup.com.au/privacy-policy/ for full details.
